Congress Has Done Something To Protect Every LAW ABIDING American’s Constitutional Rights!

Trump’s congress protected the gun rights of millions of American’s this week, by overturning a grossly unfair regulation put into effect by Obama just before he left office.

The gun control rule targeted disabled social security recipients. If anyone receiving social security benefits asked for help with managing their finances, then they were labeled mentally defective and automatically entered into the National Instant Criminal Background Check System (NICS).

Having your name in the NICS means that you are not legally allowed to own, transport or posses a firearm.

If that’s not bad enough, you can’t appeal having your name on that list until after it is placed there. Then you must go through a grueling, lengthy process with BOTH the Social Security Administration AND the Bureau of Alcohol, Tobacco, and Firearms. All because you requested help with your finances?

But it’s even worse than that. The rule that allows a Social Security recipient to request financial help ALSO allows the Social Security Administration to appoint one for you whether you want or need one. Specifically the law says “regardless of the legal competency or incompetency of the qualified individual.”

The NICS database is also used to clear people for certain types of work. It’s used to grant security clearances, some businesses that work with money check to see if your name is in the criminal database and so on. Some disabled Social Security recipients may need temporary financial help while they’re recovering from a serious health issue.

If the Obama-based rule were to stay in place, those temporary help situations would put tens of thousands of people in the position of not being able to go back to work once they’ve recovered.

All of these things were put into place without due process. The rule that Obama put into place allowed the government to take away the rights of law abiding citizens. Without a hearing. Without legal representation. In some cases without any choice. That is not what this country is about, and that set a very dangerous precedent that gave the government too much power.

The new ruling by congress this week too much needed steps to reverse the regulation Obama put into place, and solidified the rights of all American citizens, whether they’re disabled or not.
